This Policy explains how we process personal data of customers, website visitors, account users, newsletter subscribers, business partners and persons communicating with us.
1. Controller and DPO
The controller is MOANA DS, s. r. o.. No Data Protection Officer is currently appointed. If processing changes materially, this will be reassessed.
2. Principles
We process data lawfully, fairly, transparently and only to the extent necessary. We do not sell personal data. We provide data to third parties only where necessary for orders, legal duties, protection of rights or based on consent.
3. Data we process
For orders we process name, address, e-mail, phone, order, payment, invoice, delivery and communication data. For accounts we process login and order history. For newsletter we process e-mail, consent history and interaction data. For website visits we process technical data such as IP address, cookie identifiers, device, browser, operating system, website behaviour and traffic source depending on cookie settings. For complaints and withdrawal we process data needed to handle the request.
4. Purposes and legal bases
We process data for: order fulfilment and contract performance; invoicing, accounting and taxes; complaints, withdrawal and legal claims; customer account; newsletter based on consent; marketing and remarketing based on consent where required; analytics based on consent where required; website security and fraud prevention based on legitimate interest; reviews; and possible future live chat/customer support.
5. Systems and recipients
We may use WooCommerce/WordPress, hosting, Stripe, Packeta, accounting software, Google tools, Meta Pixel, TikTok marketing tools, MailerLite, Google Reviews and internal tools. Some tools may be changed, replaced or disabled. Current cookies and tools should be listed in the cookie banner/settings.
6. Transfers outside the EU/EEA
Some providers, especially Google, Meta, TikTok, Stripe or MailerLite, may process data outside the EU/EEA or belong to international groups. We rely on available GDPR transfer mechanisms such as adequacy decisions, Standard Contractual Clauses or other safeguards.
7. Retention
Order, invoice, tax and accounting data are generally kept for 10 years from the end of the relevant accounting period unless another period is required. Complaint and legal-claim data are kept during defect-liability and limitation periods. Customer accounts are kept until cancellation unless legal duties require retention. Newsletter data are kept until unsubscribe/withdrawal. Consent records may be kept for a reasonable period to prove compliance. Security logs are kept for a reasonable operational/security period.
8. Data subject rights
You have the right of access, rectification, erasure, restriction, portability, objection and withdrawal of consent. Contact us at support@moanads.eu. You may lodge a complaint with the Slovak Data Protection Authority, Hraničná 12, 820 07 Bratislava 27, Slovak Republic, dataprotection.gov.sk.
9. Cookies
Cookies are small files stored on the user’s device. We use Complianz for cookie consent management. Users can change settings at any time via the cookie banner/settings link. Cookies are divided into necessary, analytical, marketing and preference cookies. Necessary cookies enable core website, cart, checkout, security, login and consent functions and may be used without consent. Analytical cookies such as Google Analytics and marketing cookies/pixels such as Google Ads, Meta Pixel and TikTok Pixel are activated only after consent where required. Users may reject all non-essential cookies without losing basic access to the online store.
10. Examples of tools
WooCommerce/WordPress may use cart, checkout and session cookies. Stripe may use technologies necessary for payment and fraud prevention. Google Analytics may measure website traffic. Google Ads, Meta Pixel and TikTok Pixel may measure ads and remarketing. MailerLite processes newsletter subscribers. Packeta processes delivery data. The detailed list of cookies, providers, purposes and durations should be displayed in Complianz settings because active plugins and tools may change.
11. Newsletter
We send newsletters only to subscribers who gave consent. Subscribers can unsubscribe via the link in each e-mail or by contacting us.
12. Security
We use appropriate technical and organisational measures such as access limitation, passwords, encrypted connection, updates, security plugins, backups and permission control. No system is absolutely secure. In case of an incident, we will proceed under GDPR and applicable law.
13. Changes
We may update this Policy due to changes in law, tools, cookies, suppliers or processing. The current version is published on the website.
